Key Responsibilities:

Appearances in the magistrate court and regional court for various matters including application to compel, application for summary judgment, and application to strike out defence.

Attending tribunal hearing to remove director and defending the application for the removal of director of the company.

Drafting various combined summonses and particulars of claim for general litigation matters.

Drafting divorce court documents.

Attending to complete procedure of divorce documents.

Drafting reports on updates of various litigation matters, reporting to directors of the firm.

Drafting legal quotations and invoices.

Instructing external attorneys to file court documents, requesting updates on matters from external attorneys.

Drafting legal opinions on the BCEA, and other employment laws.

Drafting various CCMA notices and documents, including referral for conciliation, objecting to arbitration commencing immediately after conciliation.

Drafting legal representation application and supporting affidavit for legal representation in CCMA.

Conducting research on Companies Act and drafting legal opinion on Companies Act.

Reviewing memorandum of incorporation with regards to compliance of MOI with the Companies Act.

Drafting employment contracts, drafting notice of termination of employment agreement, drafting verbal warnings and written warnings of employees.

Drafting various commercial agreements, including shareholders agreements, loan agreements, indemnity agreements, sale of shareholding agreements, memorandum of incorporation agreements, drafting sale of business agreement, drafting acknowledgement of debt agreements, drafting payment plan agreements drafting surety agreements.

Legal research on a broad range of commercial law aspects

Consulting with clients/advocates.

Attending to requesting tender documents of public body using the Promotion of Access to Information Act and the Promotion of Administrative Justice Act.

Attending to urgent applications to interdict municipality to commence with the awarded tender application.

Drafting letters with regards to restraint of trade, attending consultation with regards to restraint of trade.

Conducting research on Occupational Health and Safety Act.

Conducting research on Employment laws and drafting legal opinions on employment laws.

Drafting various legal opinions on commercial matters, including lease agreements, shareholders agreements, Memorandum of Incorporations.

Attending to completing company documents to register new companies with CIPC.

Providing various legal advice to clients on commercial issues, including possible legislation on their commercial issues.
